Lego Rock Band song list is also Rock Band song list

Even if you're not into playing the family friendly Lego Rock Band, if you buy the game and pay a $10 fee, you can expand your Rock Band set list by 45 songs. From the announced set list for Lego Rock Band come the following details about exporting the songs:

Disc export will rely on the technology pioneered by Harmonix to export tracks from the original Rock Band disc to the music library of Rock Band 2. Owners of LEGO Rock Band on Xbox 360 and PlayStation 3 will be able to enter a unique code from an insert in their game manual into a dedicated website. The website will provide instructions allowing owners to unlock the export functionality of LEGO Rock Band. At that point, players will be able to export tracks from LEGO Rock Band to their hard drives for play in all game modes of the Rock Band Music Platform for a nominal export fee of $9.99 (800 Microsoft Points). An internet connection is required to perform this disc export.

Oh dear. £7 is not that nominal when you've already payed £40 for the game you're exporting from - the content is already licensed for the platform rather than individual discs so there's no excuse for charging. This is going to be quite interesting, Harmonix are seen as the 'good guys' to Activision's 'bad guys' - something that's mostly been borne out by their behaviour - but this blurs the line a bit.

Really, Sup3rt3d, you know this for certain? You've seen the licensing agreements? It this is true, why no Beatles export?

Yes I do - Beatles was a special case, due to the (notorious) intractability of Apple Corps when it comes to licensing and the 'vocal harmony' feature which isn't present in the other games, meaning the songs aren't compatible anyway.

Harmonix have said that since RB1 they license songs for use by Rock Band as a platform, which is why all the DLC can be used in both games, and will be useable in Lego RB as well. When they charged a fee to transfer the songs from RB1 the reason was they gave was that the songs had only been licensed for that game, and the fee covered re-licensing them for the platform as a whole.

Having the download linked to a one-time code in the manual is fair enough, it encourages people to buy new rather than preowned and prevents people just renting the game for the weekend to copy the songs. But charging as well? Just unneccessary.

Still, it's better than the GHWT export.

Whatever the fine print might be, I agree that it's steep to be asking $10 more for a game you already paid for. What's worse, I look at that song list and see a lot of stuff I want. Family friendly or not, that's just a good list. Dang. But "full + $10" is too much money to get it into RB2... so I'll have to pass completely.
