Activision files legal claim against Brutal Legend

Looking forward to Brutal Legend, the heavy metal adventure created by Double Fine and starring Jack Black? Uh oh. The game's original publisher, Activision, has filed a lawsuit to the effect that it still has publishing rights. The suit claims:

the developer was not allowed to seek a new publisher unless the original agreement was terminated by Activision Blizzard. It also claims that neither Double Fine nor EA have paid back Activision Blizzard any of the game's original production budget.
Sounds pretty nasty, but my guess is that this won't delay the game. Instead, there will be a behind-the-scenes exchange of money behind the scenes and a lot of trouble for some poor contract lawyer working for Electronic Arts, the company that thought it has secured the publishing rights. In other words, it's just like The Watchmen lawsuit, but with a videogame.
